These terms apply to all orders placed on foragemushrooms.co.uk. Please read them before ordering. If you are a consumer, nothing in these terms affects your legal rights under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

2. Our products

  • Our mushrooms are fresh, perishable, natural produce grown on our farm in Cornwall. Size, shape and colour vary naturally, and product photos are for illustration.
  • Products are sold by the weight shown. The proportion of each variety in a mixed box may vary with what is ready to harvest.
  • Our fresh mushrooms are single-ingredient products and contain none of the 14 major allergens listed in UK food law. Contact us if you have any questions about allergens.
  • Please refrigerate your mushrooms as soon as they arrive. We recommend cooking them before eating.

3. Placing an order

When you place an order you will receive an email acknowledging it. This does not mean we have accepted it. Our acceptance, and the contract between us, happens when we email to confirm your order is being prepared or dispatched. We may decline an order, for example if a product is unavailable, we cannot deliver to your address or there is an obvious pricing error. If so, we will tell you and refund any payment in full.

4. Prices and payment

  • Prices are in pounds sterling (£) and include delivery to UK mainland addresses.
  • Fresh mushrooms are zero-rated for VAT, so no VAT is added to their price.
  • Payment is taken in full at checkout. We accept the payment methods shown at checkout.
  • If we discover an obvious pricing error before accepting your order, we will contact you before going ahead.

5. Delivery

We deliver to UK mainland addresses only, by DPD. Orders placed by 12 noon on Tuesday are dispatched on Wednesday for delivery on Thursday; later orders are dispatched the following week. Full details are in our Delivery information. If you order to an address we can't deliver to, we will cancel the order and refund you in full. Responsibility for the products passes to you on delivery, including delivery to a safe place you have chosen. Because our products are perishable, please make sure someone can receive them or that you have given a suitable safe place.

6. Your right to cancel

Under the Consumer Contracts Regulations 2013, the usual 14-day right to cancel does not apply to goods that are liable to deteriorate or expire rapidly, which includes our fresh mushrooms. However, if you change your mind before your order is dispatched, email us and we will cancel it and refund you in full.

7. If something is wrong with your order

Our products must be as described, of satisfactory quality and fit for purpose. If your order arrives damaged, spoiled, incorrect or incomplete, please contact us as soon as possible, ideally within 48 hours of delivery, with your order number and photos. We will offer a replacement or a refund, as set out in our Refund policy. This does not affect your statutory rights.

8. Our liability

  • We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill.
  • We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for breach of your statutory rights as a consumer.
  • We supply our products for domestic and private use. If you buy as a business, we are not liable for loss of profit, business or opportunity, and our total liability is limited to the price of the order concerned.

9. Events outside our control

We are not responsible for delays or failure to perform caused by events outside our reasonable control, such as extreme weather, crop failure, carrier disruption or power failure. If this affects your order, we will tell you as soon as possible and refund you for anything we cannot supply.

10. Trade and wholesale customers

Supply to restaurants, shops and other businesses may be on separately agreed terms. Where no separate terms are agreed, these terms apply, except that sections 6 and 7 apply only as far as the law requires for business customers.

11. Your personal data

We use your personal data as described in our Privacy policy.

12. Changes to these terms

We may update these terms from time to time. The terms that apply to your order are those shown on our website when you placed it.

13. Law and disputes

These terms are governed by the law of England and Wales. If you are a consumer, you may bring proceedings in the courts of England and Wales, or in Scotland or Northern Ireland if you live there. If you have a complaint, please contact us first at hello@foragemushrooms.co.uk and we will do our best to resolve it.
